Trade Secret and Intellectual Property Litigation


 

At the heart of many business disputes is a battle over control over technology or know-how that confers a distinct, and hence valuable, advantage over competitors in the marketplace.  These issues may arise in business dissolutions, in connection with claims of breach of contract or business torts, or in conjunction with disputes over restrictive covenants. 

Jason has both prosecuted and defended such claims, sometimes working in conjunction with clients’ long-standing intellectual property counsel to litigate these matters.  His representative engagements include the following:

  • Representation of wastewater treatment technology manufacturer against Canadian company in dissolution of joint venture, including negotiating resolution involving complex licensing agreement for intellectual property, and subsequent prosecution of claim against Canadian firm for violating settlement agreement.
  • Defense of company and shareholders against claims asserted by separate company that the firms had formed a joint venture to manufacture and market a floor application, and that defendants had misappropriated plaintiffs’ trade secrets in marketing competing product.
